We have made updates to our Terms of Service. The updated Terms of Service are effective May 1, 2020 ('Effective Date'). Please know that by continuing to use or participate in LatinX in AI (LXAI) platforms and services after the Effective Date, you are accepting our updated Terms of Service.

Accident Waiver and Release of Liability

By participating as a member, ally, event holders, sponsors, and organizers of the LatinX in AI community, you acknowledge that you take action for yourself, your executors, administrators, heirs, next of kin, successors, and assigns as follows:

AGREEMENT TO FOLLOW DIRECTIONS

I agree to observe and obey all posted rules and warnings, and further agree to follow any oral instructions or directions given by Accel AI Institute, or the employees, representatives, or agents of Accel AI Institute, including members of the board of LatinX in AI (LXAI), organizers, or volunteers. I further agree to abide by any and all code of conduct set forth by Accel AI Institute and LatinX in AI (LXAI) as well as any Conferences or Venues in which they co-locate their activities.

ASSUMPTION OF RISK AND RELEASE OF LIABILITY

I recognize that there are certain inherent risks associated with the above-described activity and I assume full responsibility for personal injury to myself and (if applicable) my family members, and further release and discharge Accel AI Institute or it’s affiliate organizations for injury, loss or damage arising out of my or my family’s use of or presence upon the forum, facilities, whether caused by the fault of myself, my family, Accel AI Institute or other third parties.

I HEREBY ASSUME ALL OF THE RISKS OF PARTICIPATING IN ANY/ALL ACTIVITIES ASSOCIATED WITH THIS FORUM AND EVENTS, including by way of example and not limitation, any risks that may arise from negligence or carelessness on the part of the persons or entities being released, from dangerous or defective equipment or property owned, maintained, or controlled by them, or because of their possible liability without fault.

(A) I WAIVE, RELEASE, AND DISCHARGE from any and all liability, including but not limited to, liability arising from the negligence or fault of the entities or persons released, for my death, disability, personal injury, property damage, property theft, or actions of any kind which may hereafter occur to me including my traveling to and from activities, THE FOLLOWING ENTITIES OR PERSONS: The Accel AI Institute and LatinX in AI (LXAI) and/or their directors, officers, employees, volunteers, representatives, and agents, and the activity holders, sponsors, and volunteers;

(B) INDEMNIFY, HOLD HARMLESS, AND PROMISE NOT TO SUE the entities or persons mentioned in this paragraph from any and all liabilities or claims made as a result of participation in this forum or activities, whether caused by the negligence of release or otherwise.

I acknowledge that Accel AI Institute and their directors, officers, volunteers, representatives, and agents are NOT responsible for the errors, omissions, acts, or failures to act of any party or entity conducting a specific activity on their behalf.

INDEMNIFICATION

I agree to indemnify and defend Accel AI Institute and LatinX in AI (LXAI) against all claims, causes of action, damages, judgments, costs or expenses, including attorney fees and other litigation costs, which may in any way arise from my or my family’s use of or presence on the forum or upon the facilities.

FEES

I agree to pay for all damages to the facilities caused by any negligent, reckless, or willful actions by me or my family.

APPLICABLE LAW

Any legal or equitable claim that may arise from participation in the above shall be resolved under California law.

NO DURESS

I agree and acknowledge that I am under no pressure or duress to sign this Agreement and that I have been given a reasonable opportunity to review it before signing. I further agree and acknowledge that I am free to have my own legal counsel review this Agreement if I so desire.

ENFORCEABILITY

The invalidity or unenforceability of any provision of this Agreement, whether standing alone or as applied to a particular occurrence or circumstance, shall not affect the validity or enforceability of any other provision of this Agreement or of any other applications of such provision, as the case may be, and such invalid or unenforceable provision shall be deemed not to be part of this Agreement.

PHOTOGRAPHY AND VIDEOGRAPHY RELEASE

I understand while participating in this community, forum, or events, I may choose to submit my photograph to the organization or may be photographed during official activities. I agree to allow my photo, video, or film likeness to be used for any legitimate purpose by the activity holders, producers, sponsors, organizers, and assigns.
